Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and TCWeb Services. By creating an account, ordering, or using our services, you agree to these Terms.

1) Who we are & contact

2) Definitions

Services means hosting, VPS, reseller hosting, DNS, email, and related products. Client means the person or entity entering these Terms. Free Tier means any no-charge plan. Paid Plan means any plan with recurring or one-off fees. Platform includes our control panels and APIs.

3) Eligibility & account

  • You must be at least 18 and able to enter contracts.
  • Provide accurate registration/billing/abuse contacts; keep them current.
  • You’re responsible for all activity and credential security.

4) Services & ordering

  • Orders are offers to buy; we may accept or refuse.
  • Provisioning may be automated; fraud/abuse checks may delay activation.
  • Plan descriptions/limits are shown at order time.
  • Planned maintenance may occur with reasonable notice where practicable.

5) Domains & subdomains

  • Your domains: You manage DNS/NS unless purchased/managed through us.
  • Free subdomains: Provided for use with our services only (e.g. name.urbex.me.uk, name.freesite.info). We may suspend/withdraw to prevent abuse, infringement or operational issues.
  • Registrations/transfers: If we register/manage a domain, registrar/registry terms also apply. Domain fees are non-refundable once submitted.

6) Acceptable Use Policy

Do not use the Services for unlawful, harmful or disruptive activity. Examples:

  • Malware, phishing, fraud, impersonation, doxxing, unlawful personal-data sharing.
  • Network abuse: DDoS, mass scanning, brute forcing, open relays/proxies, TOR exit nodes.
  • Spam: unsolicited bulk email/SMS, purchased lists, affiliate spam.
  • Cryptomining or CPU/GPU/IO heavy daemons on shared plans.
  • Infringing or illegal content; content that exploits or incites violence/hatred.

7) Resource limits & fair use

  • Shared plans have fair-use limits (CPU, RAM, IO, processes, inodes, bandwidth, dbs, mailboxes). We may throttle to protect stability.
  • VPS resources are dedicated per plan; fair-use on network/shared infra still applies.
  • Free Tier: reasonable personal/non-commercial use; inactivity (no login/traffic for 90 days) may lead to archival or deletion after notice.

8) Payments, refunds & VAT

  • Paid Plans renew automatically unless cancelled in the client area before renewal.
  • Prices in GBP; UK VAT charged where applicable.
  • Invoices are due on issue; late/failed payments may trigger suspension and fees.
  • Refunds: Domains/SSL/setup fees are non-refundable once ordered from suppliers. Hosting/VPS refunds per any product-page guarantee; otherwise discretionary.
  • Consumers (UK): Consumer law applies. You consent to immediate performance on activation and acknowledge the statutory cancellation right may be lost once delivery begins.
  • Chargebacks may incur an admin fee and immediate suspension.

9) Suspension & termination

  • We may suspend/terminate for non-payment, abuse, security risk, legal request, or material breach.
  • You can cancel anytime in the client area; service typically runs to end of paid term.
  • After termination, data may be deleted immediately or after a short grace period unless law requires retention.

10) Backups & data

  • Unless your plan includes backups, you’re responsible for your own.
  • Included backups are best-efforts and not a substitute for your copies.
  • We may scan, copy or move data as needed to operate and secure the Services.

11) Email & deliverability

  • No inbox placement guarantee; third-party filtering/reputation applies.
  • Bulk/automated mail prohibited on shared plans unless permitted; transactional limits may apply.
  • Maintain correct DNS (SPF, DKIM, DMARC) where applicable.

12) IP, content & takedown

  • You retain your content rights; you grant us a limited licence to host/transmit/cache.
  • Report infringement to abuse@tcwebservices.co.uk with URLs, evidence and contact details. We may disable access while investigating.
  • Our brand/site/software/docs are our IP or licensors’ and not licensed beyond service use.

13) Security

  • Keep software updated; use strong unique passwords and MFA where offered.
  • Notify us of suspected compromise; we may take emergency action to protect the platform.

14) Beta & Free services

  • Provided “as is” with no SLA, support commitment, or availability guarantees.
  • We may modify or withdraw at any time.

15) Changes to the services and these Terms

  • We may update services/Terms; material changes notified by email or portal notice with reasonable lead-time where practicable.
  • Continued use after the effective date = acceptance.

16) Liability & indemnity

  • Nothing excludes liability for death/personal injury by negligence, fraud, or other non-excludable liability.
  • Otherwise, to the maximum extent permitted by law, we exclude implied warranties and liability for indirect/consequential loss or loss of profit, revenue, data or goodwill.
  • Total aggregate liability in any 12-month period is limited to sums paid for the affected Service in that period (or £50 if Free Tier only).
  • You indemnify us against claims arising from your content, breach of Terms, or violation of law.

17) Governing law

England & Wales law governs. Courts of England & Wales have exclusive jurisdiction, save that consumers in Scotland or Northern Ireland may bring proceedings there.

18) Miscellaneous

  • Privacy: see our Privacy Notice.
  • Notices: sent to your account email and deemed received upon sending.
  • Assignment: you may not assign without consent; we may assign as part of reorganisation or sale.
  • Severability: if a clause is invalid, the rest remains effective.
  • No waiver: failure to enforce isn’t a waiver.
  • Force majeure: no liability for events beyond reasonable control.
